Section 702 is up for renewal this year. That’s the program that allows the NSA to vacuum up the content of electronic communications across the globe. At least one of the parties to the communication must be “foreign,” but one can be – and often is – a U.S. person. So our communications are being swept up at an alarming rate.

And, the FBI has been helping themselves to this data, rummaging through it for information about Americans on the thinnest of pretexts without a warrant. They did it 3.4 million times last year!

We have a chance this year to put an end to that.

Join us as we demand an end to Section 702 unless Congress passes HUGE surveillance reform measures that go far beyond Section 702.

Subject: Rein in Mass Surveillance under Section 702

Message:

Surveillance reform is important to me. You have an opportunity this year to enact major reforms to protect my privacy, and that of all Americans.

Section 702 of the FISA Amendments Act has been used to spy on Americans since it was passed. Although Congress intended the law to allow the NSA to collect foreign intelligence related communications of non-U.S. persons, we know that the communications of millions of Americans have been swept up in this dragnet. We also know that the FBI claims that its searches of this data are exempt from the Fourth Amendment’s warrant requirement.

Section 702 will sunset at the end of this year. I urge you to allow it to sunset unless significant reforms to US government mass surveillance that abide by the following principles are included:
1. Any surveillance of Americans should be undertaken only pursuant to a statute, duly enacted by the people’s representatives in Congress (ie: not under Executive Order 12333).
2. Any surveillance of Americans should be undertaken only pursuant to a probable-cause judicial warrant.
3. Any surveillance of Americans should be subject to adequate mechanisms—in both Congress and the judiciary—to ensure accountability for compliance with governing law.
4. “Surveillance” should be defined broadly, to include (among others) data purchases, searches of databases compiled by governments, and searches of private records held by third parties.
